Just wondering





Since my attorney has formally asked for disclosure of documents withheld from my previous personal request of the Board they may be held liable for the the production there of. My attorney has asked from the depository, has there been any alterations or has any entity directed to withhold this information? Good question. As several of the previous Board has arrived in Rockport on 4/17. I questioned the prevailing Board as if previous Board where allowed to review Phase II records at Brenda's office and when did they ask to review records as I was put off for some 90 days. I would like to know WHY, does the review of previous Board members records have precedence over my request? It's time to face the music and the sachem of using common elements with Board consent is going to end , as well as the conflict of interest of the same. YES it's time to present to the Board the true entent of Phase II Declaration.

Six months without any financials?

















I'm wondering why the association hasn't seen any financials since Sept of 2010? Could it be these financials are being withheld by some entity or person, that's what my attorney is asking. Why, is a non-profit corporation hiding it's financial status. The current Board has evaded many questions as to the previous Board's activities, are they going to give amnesty to the questionable actions of the previous Board as Phase 1 did? I'm not sure but let's ask. It's also been asked if any payments were paid to owners for the use of common elements of the rental company? As per our Decluration and By-Laws gives the Board to athority to barrow money? Without financial statements how are we to know if this has happened? Has it happended aleady?

Return home & more




Arrived back home with a few snow banks in the yard and been busy getting the boat ready when the ice on the lakes melts, also picking up leaves at several properties, and attacking the honey DO list. We are expecting some 2" of snow tonight as I can count on one hand the hours I've been in shorts. On the business side all current Board members and Cpa's office has received a 29 page request of documents. And the previous Board has been asked many questions under oath as to activities during their tenure. I'm hoping the current Board doesn't continue business as usual as their arrogance could cost the association many dollars.

Wheels of Justise still turning

It appears the Board drug their feet too long in providing documents as a lengthy request was dumped on the registered agent of Phase II HOA and expenses will ultimately be presented to the HOA. There are several questions being asked of the previous Board and one of them being, has the rental company paid rent for the use of Phase II common elements including the front office. The party's over


Turn out the light the party over. It appears the Board is still playing games when asked to review documents all association members are entitled to see. Because of this foot dragging the HOA will now have to pay for my requested documents through Texas disclosure. It all most seems like the Board has inherited the same trait as the previous, why, is there something to hide?
